Sachin1069
Hi, My current H1 & my spouse H4EAD ends at Sept 30th 2018. My GC priority Date is May 2013 filed by Company A. Now, i got Full-time at company B. They will start GC after 6 months of joining tentatively. I informed about Full-time to Company A. Company A said, they will withdraw i140 along with H1, once my H1 is transferred to company B. Company B said, they will do premium processing for H1 transfer but they can’t include H4EAD extension because it doesn't fall under 180 days of expiration (Sept 30th 2018). Now my question, after H1 transfer is done successfully, obviously my Company A will withdraw h1, and i140. Can i do extension for H4EAD standalone, even after my i140 petition is withdrawn from Company A? Thanks in Advance. Quote Link to comment
NotAnAttorney
Yes, you can. From above information, the I-140 was active at-least for 180 days after approval. So you should be good. Quote Link to comment
