verma001
I got my first H1B under cap-subject category. After few years I moved to a non-profit organization and transferred my H1b there (my current employer). Now I am planning to take a position at a - for profit private company. I wish to transfer my H1B there. I am not aware of anything about cap-subject and cap-exempt transfers. As my first H1b visa was issued under cap-subject category. I want to ask , can i transfer my H1B to a for profit organization now at anytime? or does it need to happen under a new H1b (on 1st April)? If on 1st April, am I allowed to work as soon as I receive confirmation from USCIS? or do I need to wait until October 1st? I would like to thank you in advance. Link to comment
NotAnAttorney
Yes, new cap-subject employer can file H1B( which will be cap-exempt as you were once counted against the cap-quota). Link to comment
JoeF
If you have been counted for the quota and haven't used the full time, you are cap-exempt, regardless of for-profit or non-profit. Link to comment
