My employer filed for my PERM back in 2013 ( I was on L1 visa from 2007 till 2011 and in 2012 the Visa was changed to H1 from L1). My PERM went to RFE and got declined for some error. I had to travel back to India in 2013 because of max out time. In the meantime, the employer filed the PERM again in 2014 and it went to RFE again and eventually got approved in 2016. 2. While I was in India, employer filed for the H1B again in the CAP and it got picked in lottery in 2015 and I came back to USA on fresh H1 in Nov 2015. 3. While I was in US, in 2016 the PERM got approved and I 140 also has been approved now. My question is, my PERM was tied to my old H1 and hence there is no linkage of PERM and I 140 to my new H1. Is it necessary to transfer the approved I140 to my current H1? My question was in line that if I max out my current H1 (first term is expiring on July 2018 and I will get another 3 years on this H1), will I be eligible for unlimited extension on this H1 (beyond 6 years) based on my approved I140 from old H1? pontevecchio Posted February 18, 2018 Report Share Posted February 18, 2018 I-140 AND H1 are separate entities. Based on an approved I-140, you are eligible for extensions of H1 beyond the initial total of 6. Link to comment
skk007 Posted February 19, 2018 Author Report Share Posted February 19, 2018 Thanks for the response. So no need to worry about linking the new H1 with I140 as of now and I still can use the I 140 to get my new H1 extended beyond initial 6 years. Link to comment
