Urgent: Expiring L2, have L2-EAD, I-485+EAD pending - can i continue to work?

Hi,

I am currently on L2 status and have started working using my L2-EAD.  However, my spouse will be losing L1-A status next week.  I have an approved I-140 and have applied for AOS (I-485) along with AP+EAD - but it will take a couple of months to get approval.

Can I continue to work on the current EAD until I get an approval for my I-485 EAD?

If my employer files for an H1B for me based on my approved I-140, can I continue working as soon as the H1B application has been filed?

Any help/direction will be greatly appreciated.

The onus is on the employer should he employ somebody with invalid work authorization. You cannot legally work once your spouses L1A is over. You cannot start working in H1 status without approval.

Go for L2 -> H1b premium transfer based on already approved I 140. You would get results in 2-3 weeks. During this time, go on un-paid vacation at your current work place.
