HIT & RUN DRIVER REQUIRED TO PROVIDE INFORMATION Continued for dismissal 3. HIT & RUN PROPERTY DAMAGE (DRIVER REQUIRED TO STOP) Continued for dismissal After paying the restitution, below are the details for continued for dismissal Monitoring - Adult: Type: Unsupervised Monitoring without ConvictionTerm of 364 Days 01/18/2018 - 01/17/2019Status: Active 01/18/2018 Condition - Adult: 1. No same or similar, 01/18/2018, Active 01/18/2018 I'm not arrested. The victim has filed the case against me and i proceeded with the case. I plead not guilty (as i couldnt pull over due to traffic) and the jury understood it. He didnt gave any fine for me. Instead he asked me to pay the restitution balance to the victim. After i pay it on same day, the case is being continued for dismissal with above disposition. I'm an immigrant with H1B visa. I'm planning to go to India for a vacation in few months. During my vacation i need to stamp my visa(I have an approved petition). Below are my questions. 1.In DS-160, for the question "Have you ever been convicted", what should i answer ? Yes/No 2.How this case impact my immigration? Link to comment

Thari Posted February 21, 2018 Author Report Share Posted February 21, 2018 Hi Gopal, I did not plead guilty as this was a situational decision due to heavy traffic. But jury asked to pay the settle the victim with restitution so that damages will be taken care. For the disposition, It is mentioned as above "Type: Unsupervised Monitoring without Conviction". Does it mean it is not a conviction? Link to comment
