I received 2 RFE and we cleared them out and finally received approval in Jan. After my 1st RFE response I had to go to India for an emergency. As I have my OPT valid till 2019, I was advised by my lawyers that's its okay to go. We received the documents from USCIS today and one of the document on it says that my H1b was approved but Change of status was denied for the reason- "Beneficiary departed the US during a change of non-immigrant status" My lawyers said that all I have to do is get my stamping done before my OPT expires and I'm good. My question here is I'm looking to switch my job for personal reasons and would this cause any problems if the new employer wants to initiate transfer of my H1b. Please advise.
