SHGG Posted February 5, 2018 Report Share Posted February 5, 2018 Dear Admin, Please help to advice on this I am on H1B. I got job offer from company A and I accepted the offer letter. After 2 days I got offer from Company B and I decided to go ahead with company B as they had better benefits and package. I conveyed same to Company A that I will not be able to proceed with the offer as I have better offer in hand. Now company A HR is coming back claiming I have to pay legal fees associated with H1B filing, though they have not filed H1B yet and no receipt number is provided to me. Any advices in this regard is appreciated. Below is the mail snippet from HR. "We did incur significant expenses in order to maintain your status and file an H1B on your behalf. We hope you feel that the professional course of action is to reimburse us the $2,500 in attorney fees that we have paid on your behalf only to have you accept another position" Quote Link to comment
JoeF Posted February 6, 2018 Report Share Posted February 6, 2018 They can't ask for the fees. That is spelled out in 20CFR655.731. If they actually had a lawyer, and had filed an LCA, they would know that (the relevant section # of 20CFR is listed on the LCA next to the signature line. File a complaint with DOL on form WH4.
