I-94 expired but valid I-797A and RFE for proof of maintaining status during H1 Extension

Hi,

I have a valid I797A till Jan 2018 from my new employer, but my I-94 in online portal was only until Dec 2016. This was based on my stamped H1 visa in passport from my earlier employer when I travelled out of country in 2016. Didn't notice this and had applied for H1 extension in Oct 2017. Now I got an RFE asking to provide evidence for maintaining valid status at time of filing and to provide consulate to obtain visa. How should I respond to my RFE and what are the chances for approval. Is there a cahnce of 10 year ban for not maintaining status.
