hemanv123 Posted January 7, 2018 Report Share Posted January 7, 2018 Hello, I have a question regarding my wage. The H1B petition (i-129) calls for wage of $70000/ year (prevailing). But the employer is paying me around $66000/ year. Can anyone please let me know if this will cause a problem when I go for stamping and show my paystub. Please advise. Thank you Link to comment
JoeF Posted January 8, 2018 Report Share Posted January 8, 2018 You have to get paid the prevailing wage or what's on the LCA, whichever is higher. If you get paid less, you are out of status. That of course will cause problems. Ask your employer to pay you according to the LCA. If he doesn't want to do that, file a complaint with DOL on form WH4, and find a better employer, on who follows the rules. Link to comment
