patt5599 Posted January 2, 2018 Report Share Posted January 2, 2018 My wife got H4 visa in Feb 2008 and arrived in the USA. After that, she applied for H1b and approved in Oct 2008. She worked on H1b until Jan 2010. In Feb 2010, she moved to H4 visa and living in the USA since then. Now, is she eligible for H1B cap application? Or is there any way we can re-instate her old H1b? pontevecchio Posted January 2, 2018 Report Share Posted January 2, 2018 She is entitled to 6 years minus 14 months in H1 status. A H1 sponsor needs to file a petition for her and get it approved, non cap. Link to comment
