i140 Approved. More than 180 Days. Travelling

What is the current law for H1 retention once i-140 is approved and 180 days are passed. I understand that i140 cannot be revoked by employer (excluding errors, etc). But in case candidate do not maintain H1B for elongated time (say 1-2 yeas), can he still use the existing I-140 for  taking job back in USA?

The employer can utilize this approved 140 to file for a cap exempt H1b petition.
