I am on my h1b and working through the EVC model. Got my h1b visa approved (Till 2020)  when working for end client A with Employer A.

Few months later moved to end client B with Same employer A, Within  same MSA.
Do I need to file Amendment in this case ? (My LCA got certified  with Client B) .

LCA details for Client - A - Petition Approved
Job Title - COMPUTER PROGRAMMER -
Wage Rate (Required) = 84000.00
Address :- DES MOINES , County - POLK , IA - 50309
Wage level = 2

LCA Details for Client - B
Job Title = SYSTEMS ANALYST - but Job duties remain same as previous one
Wage Rate (Required) = 92000.00
Address :- DES MOINES , County - POLK , IA - 50309
Wage level = 2

USICS says if there is material change then we have to file for amendment , not sure if I fall under this umbrella.

Please advice .

Thanks Neda for quick reply .

Actually I am planning to go india in JAN , and  I would going for stamping .

If Visa officer asked me for new petition , how I am going to explain him this part , where I don't need amendment .

Also , When searched more answers ... I could see , some says amendment required some says It's not  & that putting me into more  confusion.

If you are going for stamping...you NEED amendment.

because if you had LCA update with new client B...the new client B name is not reflected on your i129.

employer will suggest you to take end client B letter with new LCA...but its suggested to get amendment in premium before going for stamping.

would you risk your status for $1250 or so...?

Thanks Karthik -

So , If I am not travelling to India I Don;t  have to file the amendment ?

It's my mistake , I will be travelling to India Jan-2019 . $1250 I can afford  to have it in premium , That's not a big deal .

but , Just want to get confirm that staying without Amendment for being working with client -B which is within MSA is Okay and It won't create any issue .

Thanks in Advance !
