Anilxyz000 Posted November 21, 2017 Report Share Posted November 21, 2017 Hi , h1b visa with Employer A was stamped on Jan 2017 valid till 2020 , but never travelled . I want to join Employer B , who is willing to do an h1b transfer . I am positive that my h1b petition is still active since employer A still wants me to join them . I have two questions . 1 ) Is there going to be a problem if Employer B initiates an h1b transfer ( i.e UCIS requesting a RFP / Denial etc ) for what ever reasons ? 2 ) If things go through fine , can i travel to USA with the h1b Visa stamped earlier with Employer A (Jan 2017 ) , but i will be joining Employer B ? 3 ) Is it recommended that i join Employer A and then resign and join Employer B ? How long would it take to do an h1b transfer ( I think there is no premium processing anymore ) -Thank you so much for your time and answers :) Link to comment
pontevecchio Posted November 21, 2017 Report Share Posted November 21, 2017 It has been said in the forum by Murthy lawyers that getting the H1 visa stamp will mean you are considered cap counted and are able to change employers. Confirm this in your case by discussing the issue with a lawyer. Link to comment
