interview waiver program

Hi ,

My H1B expiry date was Feb 09 2017. Extension petition was filed on Jan 06 2017.

for unklnown reasons my extension petition was denied on July 26 2017 and i travelled back to india on Aug 22 2017(my employer never told me the reason for denial).since i have I140 approved . i found a new employer who filed for my new H1B under cap exempt and now the petition is approved.now my question is am i eligible for visa interview waiver program as my previous H1B expiry date falls under 1 year and the new visa is also H1B.

Please advise.

NO you're not eligible for visa waiver program because you have the denial of  most recent visa which is the same category.  You may have to go for consulate interview.

Thank you Johnny . Then my question here is visa refusal is same as petition denied? While filling DS160 there is a question which asks whether my visa was refused or my entry was refused at port of entry . Similarly for interview waiver program it questions about visa denial . Please advise .
