SamK Posted November 20, 2017 Report Posted November 20, 2017 Hello Everyone, Wanted to know if anyone else has experienced the same or similar issue and seek some advice from people if possible. My firm applied for my h1b extension (with wage level 1 LCA) under regular processing in May ‘17. I got an RFE in Aug questioning the wage level for the associated job description. My firm responded in October and upgraded my petition to premium processing. On Nov 3, The petition got denied. However, sensing a potential denial, my firm increased my salary and applied another H1b extension petition before the first one was denied and filed it with a wage level 2 LCA. I just checked the online status of my petition and it states that USCIS have mailed a request for additional evidence. I will know soon from the attorneys what the RFE is for but was wondering if anyone else had a similar experience and if so what can Be the best possible response because in my research I never came across anyone having an RFE for a wage level 2 petition. Other details: The LCA job designation was for ‘computer and systems Analyst’ this is my first H-1B extension and I don’t have any I-140 filed
AbidTarheel Posted January 29, 2018 Report Posted January 29, 2018 Hey Sam, What is the update on your case? I know a person who is similar situation. Her employer applied for ‘computer and systems Analyst’ with Level 4 pay, her extension is denied. She is going out of country this week and her employer has another position in their company they are trying to fill that position and will file H1B if no one applies. What is your current status ?
