ghosalsantanu Posted November 20, 2017 Report Posted November 20, 2017 Hi, My H1B & LCA is expiring on Dec 30 2017. My firm has not yet initiated the H1B & LCA process. What would be a safe cutoff time for my employer to file my LCA+LCA approval H1B Filing process. I mean till what date can I wait to know if they are processing my visa or not. Also is there a regulation or law where company has to inform the employee within certain amount of time if they decide not to process my Visa.

Usually if all done in right way, they can start the process and send the documents to USCIS within a week to 2 weeks timeline before expiry. If you think that they are not going to file extension, its high time you find new job/employer who is ready to file H1B.
