Help Petition valid - but out of the country

I had to come back to India during 2009 after having completed 4 years on H1. It has been more than a year now since I left the US. If I apply for a new H1 now, will I get my remaining 2 years back[ Not subject to cap]?

Or will I be subjected to cap and allowed to get only fresh valid for next 6 years?
