kbekal Posted November 14, 2017 Report Posted November 14, 2017 Hi all, my situation is as follows: I am on H1B with I140 approved and priority date July 2011. My current H1 is expiring on January 2020. I have been working as a consultant (corp2corp) for the last 7 years and now I have a good full time offer from another company. The new company is willing to do H1B but will take over my green card processing only after about a year of employment with them. A couple of years back when I had a similar full time offer, my consultancy company had said that they might revoke my I140 if I moved out and so out of fear of losing GC I did not change job. But I believe since January 2017 there is an ordinance which says employer cannot initiate revokation. Here are my questions: 1. Is it safe for me to take up the full time offer now. 2. If new company does not take over GC process in time, is it still possible for me to get my H1B extension in late 2019 based on my prior I140 approval. 3. Is there any scenario (other than loss of job) that I could lose my status and my I140 priority date. 4. My employer has not given me the original approval notice for my I140 approval but I do have a photocopy. Is that enough for my new company to port my priority date when they eventually do my GC processing? Any advice is appreciated. Thanks.
adshah84 Posted November 14, 2017 Report Posted November 14, 2017 No issue. You can change the Job your I140 can not be revoked now. You don't need original copy of I140. Copy is enough. You can extend you H1b as much as you liked on your current I140 even after you change your employer.
