SD84 Posted November 13, 2017 Report Posted November 13, 2017 Hello Experts, I have H1 Transfer initiated by Employer A and I will be working under EVC model. Employer A initiated the H1 Transfer with Vendor letter and other supporting documents and got RFE after a week the petition was filed. RFE is about Employer - Employee relationship and Employer A is forcing me to join them so we can get the paystubs / badge , timesheet etc., in order to respond to RFE. I understand that only for H1 Extensions we need to provide paystubs , badge etc., and for H1 transfer Employer A have to provide offer letter, contract , organization chart in order to get the RFE cleared. Is it wise to join Employer A while the petition is in RFE state ? Employer A is telling if it get denied then I will have to bare the expenses that incurred for filing the petition and if not I will face legal issues. your valuable suggestions/advise will definitely help me here.
JoeF Posted November 13, 2017 Report Posted November 13, 2017 It is illegal for an employer to ask for payment for the H1. This is not a good way to keep employees.
