Sariaa Posted November 12, 2017 Report Posted November 12, 2017 Hello All, I'm on H1B with I-140 approved through a consulting company (employer). The client where i'm currently working in is willing to hire me for permanent position. It is under process. Qn1: Once my job confirmed with my current client and if i quit, can my employer cancel/revoke my H1 and I-140? If they do that, what will happen? Do i need to go back to India? Qn2: If somehow my employer come to know before client hire me and if they revoke my I-140, what will happen? Appreciate all your inputs.
Chai Posted November 12, 2017 Report Posted November 12, 2017 It's advisable to resign after 180 days from I-140 approval date. That way the employer cannot revoke I-140 even though he wants to. If the new petition is under process and if you have receipt notice you are fine. No need to leave the US.
