Varahi Posted November 10, 2017 Report Posted November 10, 2017 My H1-B was approved with an Employer in Sept 2016. When USCIS made an office visit, they issued an Intent to revoke notice. Due to lack of proper documentation and substantial proof, my H1B was revoked by USCIS in JUl 2017 but not under the grounds of Fraud. If a new employer is willing to sponsor my H1-B, do I fall under Cap exempt (meaning Can the new employer apply for H1-B right away without waiting until April 2018)? Currently, I am on H4 status. Neda Posted November 14, 2017 Report Posted November 14, 2017 No, since you have never worked on H1, new employer has to file your new H1 on April 1st.
