spang09 Posted November 7, 2017 Report Posted November 7, 2017 Hi All, I got arrested for DUI in June 17 with bac 0.05 in state of California . Case was reduced to we reckless in September -17 with no dmv suspension. I did all programs required and ongoing probation. My lawyer made a deal with DA. Now, I am planning to go India in Jan-18 and get my H1B stamped from delhi consulate which I got in lottery this year. I talked to my immigration lawyer and she suggested not to leave county to avoid any potential issues. But i wanted to take advice from here Is it wise to go this early? As I feel this will anytime I go early or after waiting couple of months. How much detail should I mention in DS-160 form ? Just "conviction of wet reckless" or write more details I know I might get physical panel evaluation but I think I can pass as they check if you are suffering from alcoholism. Can some tell how was there experience with physical panel? Never drink and drive folks!
rvk2ab Posted November 7, 2017 Report Posted November 7, 2017 I was in a similar situation back in 2013. Went to stamping in India Chennai consulate within 1 year of the arrest. I was asked to go for physical panel evaluation and later approved my stamping. Hopefully this helps.

mrav85 Posted December 6, 2017 Report Posted December 6, 2017 I went on the same day booking an appointment with the Apollo Hospital. The reports were sent to consulate the very next day and for me everything in 3 weeks. Refer to my detailed post.

My BAC reading was 0.23 (higher than the acceptable limit of 0.08) Considering the collateral consequences and damage to my career that a DUI conviction could have, the court awarded me 'wet reckless' with other penalties. My H1B extension is currently in processing stage. I would like to understand if my 'wet reckless' conviction could adversely impact my H1B visa extension? Is there a possibility of RFE or denial of H1B extension? I am anxious and would appreciate any views/thoughts based on your knowledge or experience.
