We contacted USCIS on the day 15th and they said that the case has been sent to the background check unit for security purposes. I had an arrest record followed by a deportation case, which was dismissed by the court with prejudice. I wanted to know how it is probable that the delay in the case is related to the previous deportation case. Moreover, since in I-129, it is not asked if you have had an arrest record, I did not disclose this issue with my employer's lawyer. I wanted to know if someone has had similar experience and what you recommend at this time. Do you think if I disclose this to the lawyer, it will help the H1B case? I greatly appreciate your help in advance.
NotAnAttorney Posted November 7, 2017 Report Posted November 7, 2017 I personally advise to disclose this to your attorney. After all he is the only source for you who can contact with USCIS if required.
