Premium H1B delayed and its connection to an arrest record

My employer filed a premium H1B recently and it has delayed for over 43 days. We contacted USCIS on the day 15th and they said that the case has been sent to the background check unit for security purposes. I had an arrest record followed by a deportation case, which was dismissed by the court with prejudice. I wanted to know how it is probable that the delay in the case is related to the previous deportation case. Moreover, since in I-129, it is not asked if you have had an arrest record, I did not disclose this issue with my employer's lawyer. I wanted to know if someone has had similar experience and what you recommend at this time. Do you think if I disclose this to the lawyer, it will help the H1B case?
