I am with same employer, but client changed, who is around 40 miles away from current location. My primary employer, job description everything remains same. I have a planned travel to India, but we applied for new amendment and its still pending. Is it ok to travel abroad with valid stamp and amendment receipt? Pls advise. Thanks in advance.
nmurthy Posted November 6, 2017 Report Posted November 6, 2017 I got an email from my attorney after they filed my amendment. It is a routine email telling me that they filed it, but one paragraph read as below. "We recommend that you do not travel internationally while this case is pending. In the event that you are required to travel outside the U.S. before a decision is issued by USCIS, please contact our office well in advance of your departure as you may need specific instructions or documentation for reentry. " Mine was filed in premium and so got the decision within 15 days. Regardless, you should talk to your attorney before making travel plans.
Tjgarla Posted November 6, 2017 Report Posted November 6, 2017 You are ok to Travel, but since your amendment is pending you might get a consulate processing when you get an approval since you left the country during the processing.
