hi,

I am on my 6th year of h1b and my h1b is expiring in next 2 months around 15-jan and i may have an option to apply for couple of months extension based on the vacation etc taken over last 2 years. i also have my GC EB2 going on and yet to be filed due dec 2017.  i would like to know from all you experts out there what is the best option, i am currently working as a project manager for an IT firm.

1. go back to india , wait for PERM and i140 approval and come back once h1b is approved post that - i will end up 1 year min outside US

2. convert my h1b to L1A since the cap is 7 years and my employer has blanket L1. only problem i see is i have not been outside us in last 3 years

even though i was working for same employer 3 years in india 6 years back.

3. apply for extension in jan on regular and wait out 6 months until get a RFE or rejection while PERM and i140 are approved ( by july 2018)

i would like to know is option 2 feasible and allowed ? convert from h1 to l1A on 6th year of h1 while you are working for same company for last 11 years and currently on H1 as manager with last 6 years all in USA.

thanks in advance for your suggestions

regards
