Hello everyone,

Here is my case.I came to India in first week of Sept. I was selected for Dropbox as it forcefully make you choose that during filing DS160(even if you dont want to go for that).My previous visa was valid till sept11th(with different employed).I submitted the documents in Dropbox location and thought it would be a happy ending.To my surprise i got an email from Hyderabad consulate asking to attend for In person interview and fingerprints on 13th.I gave the fingerprints and the lady there said that i have to attend the interview.I was tensed a bit at that time and went to the queue.It was my turn and i moved to the window.

ME: Good Morning Ma'm

VO: Good Morning

VO: So who is your employer

Me: ABC

VO: What is your pay

ME: XXX.XX

VO:How did you know about your employer

Me: Through a job posting online

VO:Who is your end client

Me: AAA

VO:So this is a 3 yr project with AAA

Me: Yes Ma'm

VO:Is there any vendor between your employer and end client

Me: Yes Ma'm.I work in EVC model(gave the vendor details)

VO took some paper and writing something.

VO:System is showing some error.It is not showing up your employer details.We need to check something

VO gave me 221G white slip.But didn't checked anything except "Additional Administrative processing needed".

She asked me to give Client,Vendor,Employer letters and passport.

Case created: Sept'7th

On Sept13th i got an email from USConsulate to collect passport.I collected the passport and they stamped"Cancelled without Prejudice" on my previous visa.

Case last updated: Sept13th

That's it.No update so far since last 7 weeks.Don't know what kind of admin process they are doing for such a long time.I am literally begging my client to not terminate my contract as it may affect my visa.He was kind enough to extend for such long time.But its out of his hands now.He said that HR is repeatedly asking why is contractor off for such long time and he cant do anything if they have to take the decision.In the mean time my wife sent a request form to senator for followup with USCIS. She is also on H1B with approved 140.I have couple of questions here and if someone has gone through this situation or currently under this situation can answer me it would be very helpful

1.How long does this 221G Admin process takes(Wrong question to ask as there is no time limit but a ray of hope/curious is making me ask this)

2.If end client terminates my contract and if USCIS called for employment verification will they cancel my visa as i wont be working there anymore?(I contacted prime vendor and discussed about this.He said that end client HR got a call recently for some other person and she mentioned that he worked there even though his contract was terminated and his visa was approved(But everyone is not that lucky).

3.What would be the other option.As my wife is already on approved 140 can i apply for H4?And once it is approved can i go to the visa interview again?What would be the risk(They might ask about my previous H1 history)?How is the H4 Visa stamping going on these days?

4.This is not relevant to my case but just want to know.My wife's extension is in next year.What is the new extension policy?Heard that they changed extension policy.

1.Every case is unique. I feel they were unable to find your employer details during interview. Is your employer in good standing.

2. If USCIS calls for employment, even though your contract with client is terminated you are still full time employee of your employer so you have job in USA. If USCIS enquires about your contract at specified client location and if client terminates your contact and if USCIS contacts your client and if they say they terminated your contract then it is difficult.

3. You can convert to H4 and hope for best. 

4. If she is eligible she will get extension.

Sorry to hear about your situation, trust me this plague is been around for years and at some point I was the victim as well!!!

1.How long does this 221G Admin process takes(Wrong question to ask as there is no time limit but a ray of hope/curious is making me ask this) There is no specific time line to follow for these it may go from a week to forever, just FYI one of my Admin Processing is still in process from 2011!! keep the figure crossed and hope for the best.

This will be a difficult situation though, if you are not able to hold a contract with the client and USCIS may inquire with your end client, certainly they will issue NOIR.

I140 approval has nothing to do with your visa or her visa as well, if she has valid H1B then certainly you can go for H4 stamping and you should be fine as dependent visa are easy to get stamped, your H1B history should not create issue for H4 stamping.
