Here goes my question - I got H1B VISA stamped in 2015 April and it expired in Sep, 2017. I never used or traveled on that. I heard, if visa stamped and expired, never used/never traveled, can be transferred under non-cap quota by NEW company 'lets say company 'B' if with in 6 years from expiry ! is this correct ? On the other hand, if the same company who sponsored my initial H1B Petition want to extend this 2015 old petition , can they do ? Appreciate your response. Best Regards, KP
NotAnAttorney Posted November 1, 2017 Report Posted November 1, 2017 New company cannot file cap-exempt as you had never worked on H1B. If the same company want to extend, they can do by filing along with all the supporting documents details of new work location and other work related details.
