ankurvsoni Posted October 30, 2017 Report Posted October 30, 2017 Hi, This question is regarding my wife who is on an H4 visa. This is the situation: - Current stamped visa valid till - November 13th, 2017. - I-94 stamped in the passport - September 26th, 2017. - Visa extension filed and approved. - Date on visa approval notice November 14th, 2017 - November 23rd, 2020. As you can see that there is a gap between the I-94 date in the passport and visa approval notice. Is this something that can be fixed? Or does she need to go out of the country and re-enter? Can someone help with what needs to be done? Your advice is much appreciated. Thanks, Ankur Soni
pontevecchio Posted October 31, 2017 Report Posted October 31, 2017 Please do not use the word visa which is a stamp in the Passport for status which is what you mean. The very fact that she got the I94 is proof of her being legally here. It is a function of their software and nothing needs to be done assuming she has a new I94.
ankurvsoni Posted October 31, 2017 Author Report Posted October 31, 2017 Just to confirm - that gap between the 2 I94s should be OK given that the extension was filed and approved before the expiry of the prev I94?
pontevecchio Posted October 31, 2017 Report Posted October 31, 2017 Yes. The extension needs to be filed before the I94 expires. It does not have to be approved. Irrespective an I94 if given with whatever date keeps her stay legal in its entirety.
