rommy Posted October 30, 2017 Report Posted October 30, 2017 Hi All, My amendment recently got approve with out I 94 so I need to leave a country and come back again. I have valid US visa so planing to travel to US Mexico border at Texas if possible. Does anyone have exp of doing same ? My Current I 94 is valid till next year however still I need to get a new one because of I 797B. Please share your exp if you have done same in a past. Also how long we need to be out of US to get a new I 94 ? Thanks
Tjgarla Posted October 30, 2017 Report Posted October 30, 2017 Rommy when you get a H1B without the i94 which means it is a consulate processing. YOu can see the consulate mentioned on the document that you will need to go for stamping. I dont think you can go to MExico.

Tjgarla Posted October 31, 2017 Report Posted October 31, 2017 You need to consult an Attorney for this. It looks like when the H1B was getting processed you crossed the border or went to canada or mexico or something. That is the reason you would have gotten the i797 without the i94

Thanks hey rommy no need you are still in valid status. because your old petetion is still valid. I am also in a similar situtation. I applied transfer to another company and my I 94 expired. so it is showing consulate CHENNAI. i am also planning to go to mexico. i will keep you posted. lets be in touch.
