ish12 Posted October 24, 2017 Report Posted October 24, 2017 My H1b expired in 09/30/2017 My extension was filed on 08/07/2017 I got RFE now. There is a chance that my company might terminate me. I have few questions, What will happen if my company terminates me after responding to RFE before the petition is approved What will happen if my company terminates me without responding to RFE My spouse and I work for the same employer.My spouse's H1B is also in extension with RFE. Can I apply for H4 through my spouse and request my employer to withdraw my H1B extension which is in RFE.If yes, Can I legally stay in the country without travelling to home country. Please Advice.
pontevecchio Posted October 25, 2017 Report Posted October 25, 2017 If they terminate you, you have 60 days. But if that happens leave and return with a H4 visa.
