AnonymousGuy Posted October 23, 2017 Report Posted October 23, 2017 Hi, During my last H1B visa stamping attempt, i was issued 221g and was asked for medical evaluation. This was due to a DWI ticket I had in the past. After going through medical tests, i was again called at mumbai consulate and given "The foreign service of the united states of america refusal worksheet". It stated, "this office regrets to inform you that it is unable to issue a visa to you because you have found ineligible to receive visa under following sections". The section was 212(a)(1) health related grounds, apparently based on medical report sent to consulate. I told the consulate officer that there has to be a mistake but it didn't help. After a month or so, i was called again and given an opportunity to do medical tests again. I passed it the second time and got my visa stamped. Question: Is this a visa refusal that needs to go on DS 160 visa refusal question? even though everything got resolved and my visa was stamped in the end. Thank you.
nmurthy Posted October 23, 2017 Report Posted October 23, 2017 Yes. You need answer yes for visa refusal and explain the situation. You should not have any problem since you got your H1 stamped after the second round of medicals

I, then, went for stamping in Aug 2012(above details) which finally got approved after refusal. Will I still need to go through medical evaluation this time ? I hear there is a 5 year rule after which it shouldn't be an issue if there is no reoccurrence ( I don't have another ticket of any kind after the first and last DWI) Thanks.

But can you detail out what your situation was ? How many DUI's ? How many times you went for stamping after the DUI. I have been through the physical evaluation too and did not have a issue. Since you were granted visa after they called you back.

I just have that one DWI and just that one stamping after that DWI. As you said, it's hell and what you go through after the first DWI should be a good enough lesson to not put your keys in car even after a single drink. I'll go for another stamping soon for which I had this question.

In your post, when you say you marked the answer as yes on your DS160, are you referring to the arrest question or visa refusal question ? Arrest question is an obvious yes but I am not sure if my last visa stamping case counts as visa refusal.

The answer to Has your visa ever been refused is No - As you got it after a 221G. Arrest question is Yes for life. If you are going to be sent for a Panel again or not is up to the officer but therotically you should not as its past 5 years and you already did it once.
