Bob777 Posted October 22, 2017 Report Posted October 22, 2017 Hi, I am in US. My company A filed H-1B, it got approved and started from October 1, 2017. Company A merged with Company B on the same date October 1, 2017. Company B is considered as successor-in-interest and it assumes all H-1B's of company A. Now I got an offer from Company C and they are ready to file H-1B transfer. I have provided them I-797 approval notice and pay stubs which are in the name of Company A. Do i have to submit any additional documents about company merger? Will USCIS deny H1B transfer application in case no documents are provided about merger or Company B? I'm in this typical situation and I couldn't find any information on web regarding this. Please help. Thank you
pontevecchio Posted October 22, 2017 Report Posted October 22, 2017 The company merger is not your problem. Nothing is transferred. C can file a non cap H1 for you because you were cap counted and worked for a previous company.
