jatinrheen Posted October 22, 2017 Report Posted October 22, 2017 Hi, My wife was on H4 and I filed her + kids I539 4 months back with my H1B extension. During the last 4 months, her H1B got approved from her employer and she went to India and got it stamped and came back while I539 status is pending. Do i need to withdraw her I 539 application ? Should I contact my employer or her employer to do that ? Also , how can I go ahead with my Kids I 539 on my H1B extension ?
satya2k1 Posted October 23, 2017 Report Posted October 23, 2017 Either your employer or her employer have anything to do with your wife's H4. It is totally your responsibility to file her H4. So you have to send a request to USCIS to withdraw I-539 (H4 extension) application.
