Lookingforhelp Posted October 19, 2017 Report Posted October 19, 2017 Hi all, I am in a situation where I have taken an internal transfer with employer A and as a result H1B amendment is being filed by employer A due to Job/location change . I have at this time also received an offer from Employer B, who will be filing a H1B transfer for me. At this time, I have a 1797 H1B approval for the next 3 years with Employer A, although my visa stamp is not current. 1. Will there be any issues with H1B transfer while I have an ongoing H1B amendment petition. H1B transfer will likely be filed under premium processing and as a result might be adjudicated before the H1B amendment is. 2. What will happen to the H1B amendment when it comes up for adjudication? If my H1B amendment is rejected/denied, would that affect my H1B transfer approval due to the last action rule? 3. Would the last action rule apply in this case? What are the scenariosAppreciate any inputs or clarifications. Thanks!
