shrawn Posted October 19, 2017 Report Posted October 19, 2017 Hi, My H1B extension is going to expire on 10/20/2017, Attorney has said that they dont have the LCA approved yet and might take few more days. Do I have any grace period to apply for extension after my current H1B expires? If not what are my options ? I have an approved I-140 and I have completed 6 years on H1B. Thanks, D
pontevecchio Posted October 19, 2017 Report Posted October 19, 2017 Look at it another way. If they approve the extension with an I94 by using their discretion, you are fine. If they do not give you an I94, you need to leave and return with the visa. Have you actually asked your lawyer about consequences off a delayed filing and also about PP?

I know that the attorney is incompetent due to my past experience but cant do anything about it. That's the reason I am here trying to see what will be my options legally. Thanks, D
