Chances of 221G refusal for drop box

hi,

 

i am planning to go to india (kolkata) for h1b stamping. while getting an appointment online, i was informed that i qualify for drop box and was provided with a confirmation slip.

 

my dilemma is whether it would be prudent or not to travel now - what are the chances of 221G denial/withholding visa for drop box facility, 

 

I have an approved i140 and can get end client letter if required. However , my company works through two  more layers and am a bit concerned about the employee employer relationship clause. My employer is confident about stamping but its a small company and i am going to be the first H1B extension drop box case in our organisation.

 

Any suggestions would be appreciated.

Be it a dropbox or in-person interview, you have the same chances of denial/approval. Drop boxing is not increasing or decreasing your chances. In case they have more questions, consulate is going to send your passport back with a 221G and ask you to attend in person. 

DONT PANIC. Take all the documents you have (whatever you take normally for an in person interview) when you travel. Once you are in India, drop your application immediately, if possible on day 1. When you drop box, you cannot drop all the documents, but only a specific set that is allowed. Be ready with all other documents, in case they ask you to come in person. 

Also make sure you have sufficient time (say 3 to 4 weeks) in India, in case you have to attend in person. Be confident. Good luck.

Is it a risk especially for contractors (employed at a small employer who mostly does subcontracting work) who work through more than 2 layers of vendors to visit India and go for stamping more than say a FTE at an american reputed firm. 

 

Is it better to avoid travel without compelling reasons ?

There is no thumb rule for these guys....chances of 221G are same throughout the year....chances of approval are also same through out the year!!!

I would say try with dropbox first...hopefully it will be cleared there itself rather going for an interview and spending 3-4hrs of your precious long awaited vacation. For any unfortunate instance if here it doesn't go through then go for interview.
