H1bEVVC Posted October 15, 2017 Report Posted October 15, 2017 Hey yall, I work in an EVVC model. I went in for the interview on June 18, got a yellow 221g slip. No docs asked. They asked me to submit a soft copy. June 25 - docs submitted. A month later, I was called in for a re-interview. Went in Aug-28. Got a 221g with blue slip with AAP ticked. I lost my client sept 1. Consulate emailed to ask for updated i797c. I'm guessing they asked for updated i797c because my client told them I wasn't working there anymore. Meanwhile, I got an offer from another client. He's going to give me a client letter and other docs soon. What are my chances of approval?
stampwithgrace Posted October 16, 2017 Report Posted October 16, 2017 If you can overcome the earlier reason for rejection then yes you will be approved. Its all at the discretion of the visa office. Your case doesn't seem like a background check of you but the employer. If your new employer is reputed and has US and H1b employees in the US already then you should be good. Not a legal advice.

ashukla Posted October 18, 2017 Report Posted October 18, 2017 are you changing your employer?? changing the client may be a long hassle if he is not based out in same metropolitan area of your previous client...you need an H1B amendment in this case as per law!!!
JoeF Posted October 19, 2017 Report Posted October 19, 2017 This looks like an issue of employer-employee relationship, which is common nowadays when there are middle vendors. Finding another employer, either direct hire or EC, may be the best chance.

Do you think if the consulate contacts this client and get the answer they were looking for, would they approve my visa?

Nobody can really say one way or the other.

H1 extensions in the US with middle vendors are also scrutinized nowadays, due to employer-employee relationship. The best thing is to avoid situations with middle vendors. Direct employment or EC is best.

We also hired an immigration attorney. Do you think my case is convincing enough to approve? This is so frustrating... I've lost over 20 pounds.

Most importantly, a new, anti-H1 administration. They recently told USCIS to scrutinize H1 petitions much more and scrutinize extensions like initial H1s, which they hadn't done since 2004. As I said, avoid anything with middle vendors. That's nowadays very bad. Direct employment or EC is the way to go. Sorry about your weight loss, but that's the result of Americans electing Trump as President. It won't improve until he leaves office, hopefully in Jan. 2021 (earlier is unlikely.)

I finally got the email to submit my passport for final processing. i hope this means we are getting our visa and hope no more obstacles come in our way.
