savemeplz Posted October 14, 2017 Report Posted October 14, 2017 Hi I have been working for this consultancy for 6 years on h1, my current h1 expires next month. . they filed for an extension and received an rfe regarding wage level1. The law firm and my consulting company said these days wage level1 RFE is potential denial so they decided to file new lca with wage level2 and process my h1 extension. Is it really ok to do that, anyone with similar situation. please guide /suggest me.
JoeF Posted October 14, 2017 Report Posted October 14, 2017 So, why did they file in level 1 to begin with? That looks like a fraud consulting company trying to get away with paying people on H1 less than what the law requires. Find a better employer, a real one, not a fraud consulting company.

gogreencar Posted October 15, 2017 Report Posted October 15, 2017 I am on the same boat.My Employer applied new LCA with wage level 2 which can be done as your current H1 is still not expired and your payroll should match with wage level2 requirements which shd be at least 80k i guess.
