employer fires in H1

hi,

I am in h1 visa, and my wife is in f1 visa if my employer fires then to stay in the US what Visa should I need to apply or do I need to go back to India and come again

You will have 60 days to look for a new H1 sponsor.

If your employer lays you off, the employer has to pay for your flight to your home country, if you wish to go.

If you want to stay, you have a 60 day grace period to find a new H1 job.

You also can file a change of status to F2, based on your spouse's F1.

If I change to F2 do I need to go to India, get stamping and come back.

A change of status is filed within the US with form I-539. A visa stamp is only needed for entry.
