Arnab Posted October 7, 2017 Report Posted October 7, 2017 In 2015 I had my I140 approved (under EB2 NIW), but lost my job and came back to India. When my priority date becomes current, can I file for consular processing, even if I don't have any job offer from US? Or, will I need to have an US based employer or relative to file for consular processing?
pontevecchio Posted October 7, 2017 Report Posted October 7, 2017 Relatives are immaterial to the situation. NIW does not mandate a job offer as a pre-requisite. Talk to the firm of Murthy or any of your choice about the matter. You may have a good chance of returning . What is the area of your expertise? Are you still working in the same area?

pontevecchio Posted October 10, 2017 Report Posted October 10, 2017 EB2 NIW does not mandate a job offer. Hence you should be able to go back with an Immigration Visa once your dates are current. I cannot emphasize the extreme importance of getting a lawyer, maybe the firm of Murthy to go over the facts and make sure there will be no issue.
jackhardy Posted January 12, 2018 Report Posted January 12, 2018 I got my green card via consular processing. I applied under EB3 and interview was in Mumbai. They asked for job offer letter and job description.
