Boston Basi Posted October 3, 2017 Report Share Posted October 3, 2017 Hi,I finished my school last year in may and started looking for job, i got my opt approved which started from (May 23 2106). i got the job and started working (that week was mainly orientation for the job) from may 15, 2016 which was for 12 hours. now, i have a pay check and i was questioned by USCIS for working before the OPT start date. USCIS questioned me sending me letter of intent to deny when i filed for H4. i filed in beginning of this year and took them like 9 months to send me this letter.Please suggest. Link to comment
pontevecchio Posted October 3, 2017 Report Share Posted October 3, 2017 It begs the question why you started working before the OPT approval. You should discuss the situation with a lawyer who may decide based on your specifics to ask you to leave and return with a H4 visa. Link to comment

Even if it is orientation it is still part of the job, You should not have started working until you got the card in hand. Contact an immigration attorney. Link to comment
