rao.kl Posted October 3, 2017 Report Posted October 3, 2017 Hello All, Here is below my case details 1) valid H1-B VISA Stamping until July 2018 2) Passport & I-94 Expired on Sep 16 2017 -> I have applied for Passport renewal and received new passport on May 07 2017 3) H1-B I-797 Expired on June 1 2017 -> Employer A had filed for H1-B Extension by May 30 2017 I have received RFE on H1-B Extension on Sep 20 2017 , My Employer is struggling to submit necessary supporting documents for the RFE , I have received an offer from Employer B on Sep 25 2017 , Can you please let me know if I can file an H1-B Transfer to Employer B though my I-94 is expired. Waiting for your valuable inputs/suggestions as I completely confused and do not know what to do. Thanks in Advance
JoeF Posted October 3, 2017 Report Posted October 3, 2017 Since your I-94 is expired, a transfer to another employer is only possible when the current H1 extension is approved.
rao.kl Posted October 3, 2017 Author Report Posted October 3, 2017 Thank you for the reply Joe I am skeptical if my current Employer would be able to submit the necessary documents for getting the approval , that was the reason i have worked hard in getting the opportunity with the new company. Can you please let me know If I could visit the CBP office and request for an I-94 extension and then apply for an H1-B transfer or if I have any other options available Thank you.
JoeF Posted October 3, 2017 Report Posted October 3, 2017 I don't think that would work. It is already weird that the H1 visa is valid for a year longer than the H1 petition. Did you transfer in between?
