ShankarMAN Posted October 1, 2017 Report Posted October 1, 2017 Hi, My wife visa is H4, She entered into USA on 7th Sep 2015 with I-94 expiry date on 1st Feb 2016. We applied extension for both of us (H1B and H-4) and I received my I-797 approval notice with 31Dec2017, but we missed to receive my wife I-797 approval notice as we moved from one location to other. Also I received my another I-797 approval with 12thMay2018 as I had filed relocation amendment petition only for me. My dependent current status is: 1. Stamped visa I-94 expiry date 01Feb2015 in passport. 2. Have no I-797 approval copy. (My status H1-B I-797 approval notice with 12th May 2018 expiry). My question is: My wife and kid ( Kid born in USA and first time travel to India) are planned to travel India on Mid of Nov'2017 with this status. Is it safe to travel india with this status? Does my wife should have I-797 approval notice? Please reply. Thanks

ShankarMAN Posted October 2, 2017 Author Report Posted October 2, 2017 I have not applied for H4 status extension as my employer need I-797 Approval notice. Instead of applying H4 Status extension, send her to India and will go for stamping (As I have I-94 expiry on 12th May). Is it safe to travel India via middle east country with this current status?
ShankarMAN Posted October 9, 2017 Author Report Posted October 9, 2017 Her last I-94 expired on 02-Feb-2016. We applied the extension for me (primary applicant H1-B) and dependent, I received my i-797 and missed to receive her I-797 approval notice as we moved the location and forgot to update the address in USCIS.

pontevecchio Posted October 16, 2017 Report Posted October 16, 2017 If their last I94 expired in February, 2016 then your first step is to involve a Lawyer ASAP. If they leave she will be subject to a 10 year ban on return. What happened to her H4 status ending December,2017. Did she get an approval which was sent back by the post Office as you had moved? Did you at the very least enquire from USCIS about her H4 extension?
