In principle, yes, but in practice, a PhD requires your full attention, 24/7, so it is very unlikely to be possible while also working for your H1 employer.

I never heard of part time PHD, which is usually full time. That means you have to apply for COS from H1 to F1.

You cant be on 2 status (F1 & H1)  at any given time
