ram kamireddy
Hi every one I have my current I-797 valid from 03/22/2017 to 11/29/2019 from an employer B after i transferred from an employer A this year . My Visa validity is going to expire on 03/15/2018 ( I got this stamping done when i was with my employer A and visa states the same in passport ) now I have planes to get married in India on mid of Nov/2017 and planning on returning on Dec/2017 mid week . I would like to return with my fiancee . My questions are - 1)My current visa will be valid enough for me to return with out a new visa ? (I will carry my new and old I797 though) 2)just a 3 months validity on a visa from an old employer wouldn't create any issues/questions at the port of entry ? 3) What are the required documents my fiancee need to carry while attending a visa interview ? Thanks in advance appreciate your suggestions . Thank you . Link to comment

gopalakrishnach
1) Yes 2) Probably no but it depends on officer 3) There is a list of documents like Visa Appointment Letter DS 160 Confirmation Page Passport Educational Documents Marriage Certificate Marriage Photos Marriage Invitation Card DS 160 photos ( 2 ) Fee paid receipt H1B approval copy of spouse Spouse paystubs and so on Link to comment
pontevecchio
1. Yes. But no harm in both of you getting appropriate visas before you return. You can make the appointment before you are married as long as the Interview is after Marriage. 2. It would not make you inadmissible. He may ask you why you did not renew the visa and you tell him you had no time . 3. Please look up the consulate site and preferably you both should go for the Interview. Link to comment
ram kamireddy
Thank you Gopal . Probably no but it depends on officer - what could happen here ? how can i be prepared in the worst case scenario Link to comment
pontevecchio
It does NOT depend on the Officer. He HAS to let you in. Link to comment
ram kamireddy
thanks for your reply pontevecchio . "Please look up the consulate site and preferably you both should go for the Interview" So you recommending me to renew my visa as well ? I am planning on returning with out a new visa interview/stamping for myself ( if it is legally ok ) so i could avoid unexpected restrictions . I know I have a valid job with a renowned client but the current consultancy i am associated with is a start up . so i dont want to take chances of going for new stamping while i already have three months validity ( got this while i was working with my previous employer ) I am trying to do this only to stay away from any hassle i might face . Please advise Link to comment
