Therefore, I am going to take Sabbatical leave for 1 year. What visa do I enter the USA for vacation purposes during my sabbatical period? Can my leave be extended for 1 more year after next year? How to renew H-1B visa as it expires next September? Please help. Thanks.
pontevecchio Posted September 21, 2017 Report Posted September 21, 2017 What is your nationality? You are no longer in H1 status once you leave. You can take as much" leave" as you want. Practically you will no longer be an employee when you leave. At any point of time the employer wants to let you come back he will file a non cap h1 petition for you and you can come over on the visa on approval. You will need a tourist visa for short trips to this country?
JoeF Posted September 21, 2017 Report Posted September 21, 2017 You would need a B2 visa to visit. When the H1 expires, the employer needs to file a new H1 petition, and when that is approved, you can get a new H1 visa.
