litaprv Posted September 18, 2017 Report Share Posted September 18, 2017 My daughter's I 94 expired in Sep 2015 (two years ago). My H1 B was extended until Sep 2018. Since my Wife and son had re-entered to USA in Nov 2015 (after my H1B extension) they are all set with their I94s. I just realized about this huge oversight from my and my company's side that we should applied for H4 extension for my daughter at that time. VISA stamping on my passport is for SEP 2015. My Daughter's passport expires in Dec 2017. Under these circumstances what are my options and whats the best way to deal with this? Link to comment

JoeF Posted September 19, 2017 Report Share Posted September 19, 2017 A minor doesn't accrue unlawful presence when overstaying an I-94. So, the easiest way is to travel abroad and enter with a new H4 visa. Double check with a lawyer. Link to comment
