Hello Sir/Madam,

I recently received a 2nd RFE on my H1B extension petition + amendment (this is an extension beyond 6 years). My I 140 is approved last year. RFE is around linking job duties to education, detailed break up of project plan etc. My current visa will expire by end of Oct, 2017.  While me and my employer are working on the RFE response and planning to submit it in a week's time, I wanted to know what are my options in case if the petition gets denied. Below are some of the questions:

1) Should I consider 2nd RFE as a red flag or indication of denial?

2) Does Approved I 140 play any role in petition approval?

3) If I get denial before my current I 94 expires (end of Oct, 2017) then what are my options?

4) If It gets denied after I 94 expiry (end of Oct , 2017), then what are my options to continue stay lawfully in the states?

Thanks.

Thanks Preety for your response.

First RFE was more on the side of establishing Employer-Employee relationship. They asked for Org chart, performance review process, offer letter, Service contract for my project etc.

Second RFE is more specific to project details, What are the actual duties, time breakup, linkage of work to my educational background etc.

I think my Job and education do match, job title used however is too generic "comp system analyst", that might be a bit misleading. Job duties mentioned in the petition are however very true and accurate.

I hope this answers your query, so how good or badly place am I based on above situation?

Thanks

@Ayaan84I am not sure if I can still answer until I know what degree you have in bachelors or masters...if job title is computer systems analyst then are you working as a Business Analyst or something similar? What's your actual work job title?

@Ayaan84 Everything will go fine. No worries. I'm in the same boat. Have you filed your RFE response or is it in the process? Can you inbox me your mobile number
