CONSULAR PROCESSING AFTER INTERVIEW, CAN ENTER U.S WITH H1B VISA?

The primary applicant is outside of U.S, the spouse is in the U.S with H1b visa.

If after interview, they denied with additional check times, (could be a few months), could the spouse go back to U.S. with H1b visa?

In addition, if the spouse get passport request within the U.S., how could he finally get the G.C.? Does he have to leave U.S. again and activated the permanent resident visa?
