Hi All,

Here is my scenario :

1. My H1B visa validity was till May-09-2017 and my employer filed my 1st extension on Apr-17-2017. (I have approved I-140)

2. I got RFE on July-21-2017 asking explanation on Level1 wages.

3. What should my employer answer for this RFE ? will it approve on level 1 wages if we answer for it ?

4. I am planning to change another job and will apply for new LCA with level 2/3 wages with same employer ? is this possible to approve ?

can some one suggest me which option is good to go ? my employer suggest me to go with new job and said they will apply one more LCA with level 2/3 wages(my h1b visa expired on May-09/2017 , presently working on receipt number which I got RFE now).

Is it possible to apply with new LCA while 1st  LCA is in process and got RFE ?

Thanks,

pcrao

Hi, im in the same situation. My I94 is expired on April 30 and filed H1B extension, but got rfe on Wage level1. Current project is almost finished. If i get a new project with a new client, same employer... Can i file new LCA with wage level 2/3 and attach to current H1B extension petition?

How can we resolve RFE on wage level1 in this situation? What are the options do i have?

Already im paid well. But LCA was past dated and with level1 wage. Will be submitting W2s and Pay stubs as well. Anything else can be done...? Anyone got succeeded in this so far...?? Currently im facing the 2nd RFE, what is the chance of denial vs approval?

If you're getting paid well then why your LCA was filed with wage level I?

I did not get specific answer from my employer... I was told next time onwards, it will be taken care to match with LCA.

And now you're in trouble. Better find a good employer, not a shady one like your current employer.
